What this form is for
If the seller agrees to provide the buyer with a copy of an existing survey, the provision in the TREC contract forms requires the seller to also deliver either a declaration or an affidav it to the buyer and to the title company. The T-47.1 Declaration In Lieu of Affidavit is promulgated by the Texas Department of Insurance. The listing broker may provide the form of the declaration to the seller for the seller to complete, sign, and return.
